中国的"通知-删除"制度依据《信息网络传播权保护条例》（2006年颁布，2013年修订）
第14-17条 [法条原文]建立。这是一套快速、低成本且法律后果重大的系统。通知是
一项真实的法律声明，导致内容被移除而没有司法审查。反通知是另一项法律声明，使内容
恢复。两个决定都可能进入诉讼。
对于电子商务平台，同时适用《电子商务法》第42-43条 [法条原文]的"通知-删除-反通知"
机制，该机制适用于平台内经营者。
三种模式：
--send— 起草通知（条例第14条 / 电子商务法第42条）--respond— 对收到的通知做分诊；产出选项--counter— 起草反通知（条例第16条 / 电子商务法第43条）
对外发送文件（发送和反通知模式）： 通知/反通知发送给网络服务提供者。对外文件上 勿包含工作成果抬头。通知本身不受保密特权保护——它是在法定程序中的声明。内部草稿、 发送前摘要、合理使用分析和分诊备忘录保留该抬头。
法域假设
《信息网络传播权保护条例》系中国行政法规，第14-17条适用于受中国法管辖的网络服务 提供者。《电子商务法》第42-43条适用于电子商务平台经营者。其他法域有各自的 通知-行动制度。著作权的存续基于伯尔尼公约具有多边性，但执法机制是法域特定的。

第1步：识别著作权作品
受著作权保护的作品是什么？
- 作品名称/描述 — 作品是什么（软件、图片、文字、视频、音频）？
- 登记情况 — 著作权登记号（如有）。中国著作权登记为自愿，但可作为权利归属的初步证据（《最高人民法院关于审理著作权民事纠纷案件适用法律若干问题的解释》第7条
[法条原文]）。- 权属 — 我们是否完全拥有，还是持有可发送通知的独占许可？
- 在先许可 — 我们是否曾许可过此使用，或一个可能涵盖此使用的更广泛许可？
第2步：识别侵权材料及其位置
侵权材料在哪里？
- 平台/服务提供者 — 哪个平台？
- 具体URL — 侵权材料的链接
- 描述 — 侵权材料是什么以及如何侵权
- 证据 — 截图和证据保存
第3步：合理使用关口
根据中国《著作权法》第24条合理使用条款 [法条原文]，在发送通知前必须考量的因素包括：
- 使用的目的和性质
- 被使用作品的性质
- 使用的数量和质量
- 使用对作品潜在市场或价值的影响
以及《信息网络传播权保护条例》第6条规定的特定合理使用情形 [法条原文]。
逐项询问用户并记录结论。如果"可能"或"很可能"构成合理使用，不继续起草，路由至律师审核。
第4步：善意确信
确信作品的权属和使用未经授权。
第5步：准确性和授权
确认签署人有权代表权利人行事的授权。
第6步：起草通知
《信息网络传播权保护条例》第14条要求的要素 [法条原文]：
- 权利人的姓名（名称）、联系方式和地址
- 要求删除或者断开链接的侵权作品、表演、录音录像制品的名称和网络地址
- 构成侵权的初步证明材料
《电子商务法》第42条补充要求：通知应当包括构成侵权的初步证据 [法条原文]。
结构：发函人信息、收件人（服务提供者公示的接收渠道）、事由、三项法定要素、签署栏。
第7步：发送前响亮关口
呈现类似于警告函的关口格式，包含：
- 通知是真实的法定声明
- 错误通知承担民事责任（条例第24条
[法条原文]：因错误通知造成服务对象损失的，应承担赔偿责任； 电子商务法第42条：恶意发出错误通知的，加倍承担赔偿责任[法条原文]） - 确认权属、未授权、合理使用已考量、授权人已批准
第8步：输出
写入事项文件夹。聊天中以纯文本展示供审核。
接收模式 — 对收到的通知做分诊
你的内容被拿下了。平台通知你收到了通知。你有选项。
第1步：阅读收到的通知
提取：发函人、平台、被主张的作品、被指控侵权的内容、通知日期、通知表面是否符合 条例第14条要素。
第2步：评估
- 我们是否有许可？ 协商的、默示的、任何授权使用的安排。
- 是否合理使用？ 走著作权法第24条四因素。
- 通知是否有缺陷？ 缺少条例第14条要素？缺陷通知非适格通知。
- 平台是否正确遵守了条例第15条/第17条及电子商务法程序？ 我们是否被给予反通知机会？
- 发函人是否可信？
第3步：选项
A — 接受（让删除成立） | 当他们是对的，或不值得争。
B — 发送反通知 | 当善意确信移除系错误或误认。注意：反通知后权利人在15个工作日内
不提起诉讼或投诉的，平台应恢复（电子商务法第43条 [法条原文]）。
C — 直接与发函人协商 | 有商业解决空间。
D — 忽略 | 当伤害小，不想启动反通知司法管辖同意。
第4步：撰写分诊备忘录
输出至事项文件夹。
反通知模式 — 起草反通知（条例第16条/电子商务法第43条）
第1步：确认前提
- 内容因通知被移除（非平台自主的内容政策执行）
- 善意确信移除系错误或误认
- 已准备好提供不侵权的初步证明材料
- 决定系深思熟虑——非反应性、非无律师参与
第2步：依据条例第16条/电子商务法第43条起草
条例第16条要求的要素 [法条原文]：
- 服务对象的姓名（名称）、联系方式和地址
- 要求恢复的作品、表演、录音录像制品的名称和网络地址
- 不构成侵权的初步证明材料
电子商务法第43条补充：平台内经营者接到转送的通知后，可以向电子商务平台经营者 提交不存在侵权行为的声明。声明应当包括不存在侵权行为的初步证据。
第3步：发送前响亮关口
反通知是真实的法律声明——反通知后，权利人可能起诉。关口强调：
- 反通知的法律后果
- 权利人在15个工作日内可以起诉或行政投诉（电子商务法第43条）
- 我们准备好应诉了吗？
第4步：输出
写入事项文件夹。
