Zweck und Mandatsbezug
Behandelt die strukturierte Mandantenkommunikation und Erstellung von Entscheidungsvorlagen in IP- und Wettbewerbsschutzverfahren. Eine professionelle Entscheidungsvorlage gibt dem Mandanten alle relevanten Informationen – Handlungsoptionen, Risiken, Kosten, Fristen – und ermöglicht eine fundierte, dokumentierte Entscheidung.
Mandatsbezug: Mandant erhält Abmahnung und fragt: Was soll ich tun? Mandant will Marke anmelden und fragt: Was kostet das und was riskiere ich? Rechtsabteilung muss dem Vorstand eine Entscheidungsvorlage zu einer IP-Klagestrategie präsentieren.
Grundprinzipien der Entscheidungsvorlage
Prinzip 1 – Fakten vor Wertung
- Zuerst gesicherte Fakten: Was steht fest (Schutzrecht, Verletzung, Fristen)?
- Dann Wertung: Was ist wahrscheinlich, was unklar?
- Trenne: gesicherte Rechtsaussage vs. Prognose vs. Annahme.
Prinzip 2 – Optionen vollständig darstellen
- Nie nur eine Option präsentieren.
- Mindestens: Option A (aktiv), Option B (passiv/abwartend), Option C (verhandeln).
- Jede Option mit Kosten, Risiken, Zeitaufwand und voraussichtlichem Ergebnis.
Prinzip 3 – Kosten explizit machen
- Anwaltskosten, Gerichtskosten, Kostenrisiko bei Verlust.
- Eigene Kosten vs. Kostenerstattung bei Obsiegen.
- Keine Überraschungen: Mandant muss vor Entscheidung alle Kosten kennen.
Prinzip 4 – Frist sichtbar machen
- Die wichtigste Frist immer in der Vorlage hervorheben.
- Was passiert, wenn Frist versäumt wird?
